- These Terms apply to any services contracted through www.taximonit.com. Please read these terms carefully and thoroughly. They include information about the services, your rights, and other important details.
- TAXIMONIT.com will act as a mediator between you and professional taxi service providers or companies. Acceptance of these Terms and Conditions does not exclude the possible agreements or general or specific conditions required for the provision of taxi services.
- Business owners, professionals, or taxi drivers refer to all individuals, whether natural or legal persons, who operate in the exercise of their professional or business activity by providing taxi ride services.
- A User refers to any individual who contracts the services provided by TAXIMONIT.com.
1. GENERAL SERVICE CONDITIONS
The services provided by TAXIMONIT.com shall be governed by the following General Contracting Conditions, without prejudice to any legal or regulatory provisions that may be mandatorily applicable.
The User’s request for a service shall comply with the request and contracting procedure established on this website.
Service requests must be made at least 24 hours in advance. Services requested with less notice may not be accepted by TAXIMONIT.com, depending on taxi availability and the requested time.
Once the request has been formalized, the User is responsible for the payment of the agreed fees, as well as for notifying this website of any modifications, cancellations, incidents, complaints, or claims regarding the service or the agreed terms.
Reservations made through this website will be formalized, once paid, by sending an email specifying the service’s conditions. This email will include:
- The identification of the transport provider.
- The issuance date.
- The departure and arrival points.
- The price.
If the User detects any errors in this communication, they must inform TAXIMONIT.com to rectify them, in accordance with the conditions related to contract modification and/or cancellation.
To contract the services offered on this website, it is necessary to provide an email address and a phone number.
TAXIMONIT.com will not be responsible for errors or inconsistencies that the User may have made during the service booking and contracting process.
The request for a Taxi Service through the taximonit.com website will be communicated to both the User and the Taxi Service Provider to facilitate the selection of the desired specific service and to receive confirmation of taxi availability.
The taxi service provider may require the User to provide identification or show the email confirming the service booking through TAXIMONIT.com. If such identification or proof is not provided, the taxi service provider may refuse access to the vehicle or cancel the service, with no right to a refund, under the same terms established in the Cancellation clauses.
All communications made electronically between TAXIMONIT.com and the User will be stored for the duration of the complaint acceptance period and will serve as proof of notification and confirmation of delivery.
TAXIMONIT.com guarantees the User the selection of professionals with the appropriate training, professionalism, and suitability for service provision.
2. SPECIAL SERVICES
The availability of additional services such as baby seats, boosters, extra stops, or the transportation of golf equipment, bicycles, skis, pets, etc., must be consulted in advance. TAXIMONIT.com will inform the User of the availability of such services before the booking is confirmed.
3. LUGGAGE
The User has the right to transport their luggage or similar items during their journey, provided they do not exceed the usual volume appropriate for the vehicle providing the transport service. The amount of luggage included in each service is limited to the capacity of the booked vehicle, in accordance with the size, luggage space, and transportation regulations for passengers and their belongings. The User will bear the cost of any additional means of transport required for excess luggage.
The User is responsible for their luggage and belongings at all times and has the right to personally place them in the designated compartments of the vehicle and to refuse to begin the trip until the luggage is satisfactorily placed according to their judgment. If the vehicle starts the trip without the User objecting, it is understood that the trip begins with their consent and under their sole responsibility concerning the luggage.
TAXIMONIT.com and the drivers providing the service shall not be held responsible for any damage or deterioration of luggage, including damage occurring during loading or unloading, even if the User declines to perform or supervise this process personally and the driver or auxiliary staff carries it out. The User is also responsible for ensuring they remove all their belongings from the vehicle at the end of the service. TAXIMONIT.com and the drivers shall be completely exonerated from any liability regarding forgotten or lost items in the vehicles.
4. PETS
The transportation of pets or companion animals requires prior communication and approval from TAXIMONIT.com, without prejudice to any additional costs the User may incur. These animals must be transported in compliance with the applicable legal requirements and conditions. The well-being and health of the animals will be the sole responsibility of the User.
If the need for pet transportation was not communicated to or contracted with TAXIMONIT.com, the taxi service provider may cancel the trip without any right to reimbursement for the User.
5. MINORS
If minors need to be transported, this must be communicated to TAXIMONIT.com so that an appropriate taxi service meeting the legal requirements can be arranged. Each person traveling in the vehicle must occupy a seat, regardless of age. The User is responsible for any possible cancellation of the service by the taxi operator or driver if the number of passengers exceeds the capacity of the booked vehicle or if the booking did not specify the necessary special conditions for the transport of minors.
In any case, the User is responsible for properly securing children in child restraint systems. If the vehicle starts moving without the User objecting, it is understood that the trip begins with their consent and under their sole responsibility regarding the minors traveling in the vehicle.
6. PRICE
The prices and rates for the services provided by TAXIMONIT.com will be set on this website. The price will depend on the type of service booked. The fees must be paid for the service reservation to be considered accepted.
This website may establish special rates, promotions, or discounts based on the type of service and the terms of its contracting. These will be valid for the duration and conditions expressly stated on this website. The prices listed include VAT at the prevailing rate.
Service fees do not include gratuities, although the User may voluntarily provide them to the Taxi Service Provider.
7. PAYMENT METHODS
Payment will be made using any of the methods accepted on this website during the booking and contracting process.
The User will receive an invoice for the payment made via email, without prejudice to their right to request a physical copy by contacting TAXIMONIT.com’s Customer Service.
8. LIABILITY
TAXIMONIT.com acts as an intermediary between users and taxi service providers. TAXIMONIT.com is not responsible for any incidents that may occur during the provision of services by the taxi company or driver contracted by the User. This website is exempt from liability for any type of incident or damage that may occur during taxi services, for which the driver, taxi company, or relevant insurance entities may be responsible. By accepting these Terms and Conditions, the User declares that they have contracted the highest coverage travel insurance generally offered by insurance companies.
Under this contract, TAXIMONIT.com undertakes to provide the User with a taxi service provider that meets the requirements set forth in these Terms and Conditions. TAXIMONIT.com is not responsible for the quality of the service provided by the taxi company or driver. The service conditions will be as agreed upon between the User and the taxi service provider.
Neither the website nor the taxi companies or drivers guarantee or assume responsibility for any damages that the User or their companions may suffer as a result of extraordinary circumstances that may arise before or during the provision of services. These situations may include, but are not limited to, third-party accidents, police controls or operations that slow down traffic, sporting or cultural events, acts of vandalism or terrorism, protests, demonstrations, and riots, strikes, road closures for official convoys, unforeseen road hazards, acts of government or competent public authorities, natural disasters or catastrophes, fires, and adverse weather conditions. All these events, beyond the carrier’s control, will be considered force majeure, without giving rise to compensation for damages that the User or their companions may suffer.
TAXIMONIT.com is not responsible for any services that the User may contract directly with taxi drivers or companies providing the taxi service, nor for any modifications to a contract directly agreed upon with the drivers.
By formalizing their contract, the User releases TAXIMONIT.com from liability for any damages covered by the driver’s insurance, as well as for damages resulting from any illness, injury, death, or loss of money or any items or objects that the User or their companions may suffer, and must file any claims directly with the driver providing the service or the taxi company.
9. CONTRACT MODIFICATIONS
The User may make modifications to their contract up to 24 hours before the scheduled date and time of the service. Any modification request must be sent in writing to our email address, and our acceptance will be notified to the email from which it was sent, at which point the modification will take effect.
In the event of changes to the service conditions, the User will be required to pay the difference if the new cost exceeds the initial payment. If the cost is lower, no refund of the difference will be issued unless the modification was communicated to TAXIMONIT.com at least 48 hours in advance.
10. CANCELLATION CONDITIONS
The User may cancel the contracted taxi services up to 7 calendar days before the service date, with the right to reschedule for another date within one calendar year from the cancellation, without any additional payment. Any cancellation made within seven calendar days prior to the service date will not be eligible for a refund or cost-free rescheduling of TAXIMONIT.com services.
11. RIGHT OF WITHDRAWAL
In accordance with Article 103 of Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, the right of withdrawal provided in that regulation does not apply to this contract.
12. BEHAVIOR RULES
To ensure the safety of all vehicle occupants, no passenger or user may travel under the influence of alcoholic beverages, toxic drugs, narcotics, or psychotropic substances. The consumption of alcohol and other narcotic substances is strictly prohibited during taxi services.
Unless otherwise authorized by the vehicle driver, eating inside the taxi is not permitted. Smoking inside the vehicles is strictly prohibited at all times.
The transport of luggage, belongings, and objects that may soil, damage, or cause deterioration to any part of the vehicle is not allowed. This includes objects that may impair visibility or safety, as well as explosives, corrosives, flammable substances, and any other items whose possession or unauthorized transport may be prohibited by current regulations.
In the event of non-compliance with these rules, the User will be obliged to compensate for any damages caused to the driver or taxi company.
Neither this website nor the taxi companies or drivers providing the service will be responsible for any additional expenses incurred by the User if the driver deems it necessary to refuse to start the service, interrupt it, or end it before reaching the destination due to non-compliance with the above conditions.
13. CANCELLATION BY THE DRIVER
The final service provider, the taxi company or driver, may cancel confirmed services only in cases of justified cause or force majeure. In such cases, the driver must notify the User as far in advance as possible, given the circumstances of the case.
14. DATA PROTECTION
By accepting these Terms and Conditions, the User authorizes that, in accordance with Organic Law 3/2018, of December 5, on Personal Data Protection and the Guarantee of Digital Rights, and Regulation (EU) 2016/679 of the European Parliament and the Council, of April 27, 2016, regarding the protection of individuals with regard to the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), the information and personal data provided through the contracting of TAXIMONIT.com services will be transmitted to taxi service providers only for those data specifically necessary for the proper provision of such services.
15. USER COMMITMENT
By providing the flight number, the User allows the TAXIMONIT.com team and the related taxi operators or drivers to monitor the arrival or departure schedule. The arrival or departure of flights will be checked using publicly available information from AENA. Once the reservation has been confirmed at the indicated time, the User agrees to be present at the designated pickup location at the scheduled time. If the User does not arrive on time, a 5-minute courtesy period will be granted. After this period, the driver may restart the taximeter, charging for the waiting time. The taxi driver or operator may cancel the reservation 30 minutes after the scheduled time without any liability if the User fails to appear at the pickup location. The taxi driver must, in any case, attempt to inform the User of this cancellation whenever possible. The commencement of the journey without objection from the User shall indicate their agreement. If the User is unable to locate the driver or does not see the vehicle at the service start location, they must contact us by phone to receive assistance in finding the driver and beginning the journey.
16. MODIFICATIONS TO TERMS AND CONDITIONS
The website reserves the right to modify these terms and conditions of use. Any changes to the terms of use will be published on www.taximonit.com and will be available for consultation by the User at any time.
The website is not obliged to notify individual Users of any modifications; instead, notifications will be made generally through the website www.taximonit.com.
17. SATISFACTION SURVEY
Once the journey has been completed, the User may receive a satisfaction and service evaluation survey via email.
18. ACCEPTANCE
By submitting a request, the User confirms that they have read, understood, and accepted these general terms and conditions. Additionally, the User confirms that they have the legal capacity to accept these General Conditions on their own behalf and/or on behalf of their companions. Consequently, the User is responsible for making the necessary payments and for notifying any modifications, cancellations, incidents, complaints, or claims.
By entering into a contract, the User declares that they understand and accept these general conditions and agrees to pay for the requested service using a valid credit or debit card, which they are authorized to use and which has sufficient funds to cover the total cost of the contracted service.
The User acknowledges and accepts that the service will be carried out based on the data and details provided during the booking process and under the terms and conditions set forth in this document. TAXIMONIT.com shall not be liable for any damages that may arise as a result of errors in the transmission of such data and details.
The User acknowledges and accepts that they will be responsible for any damages caused to the taxi driver or third parties due to their actions or those of their travel companions.
The User expressly consents to the transfer of their personal data to local drivers providing the ground transportation service, solely for the purpose of fulfilling the service and only to the extent necessary.
19. COMPLAINTS AND CLAIMS
TAXIMONIT.com provides a Customer Service channel through which Users may submit complaints and claims as necessary.
Users must submit their complaints and claims within a maximum period of 15 calendar days following the provision of the service related to the issued communication. TAXIMONIT.com commits to responding within a maximum period of 15 calendar days.
TAXIMONIT.com is exempt from any claims related to the absence or unavailability of the vehicle at the specified place, date, and time for the service start if it does not receive notification from the User at that precise moment. This exemption applies even if the User chooses an alternative mode of transportation, assuming the driver’s absence.
TAXIMONIT.com will only accept liability for claims made by the User due to our own negligence in managing their contracts or billing errors. In all other cases, the User’s claim will be forwarded to the taxi drivers or operators responsible for providing the corresponding service.
20. APPLICABLE LAW AND JURISDICTION
These Terms shall be governed by and interpreted in accordance with Spanish law and applicable European regulations.
Without prejudice to the mandatory provisions of Spanish and European regulations, the parties agree to submit to the courts of Madrid.
By accepting, you agree to be bound by these Terms and Conditions.
